Shuman McCuskey Slicer PLLC Attorneys Obtain Dismissal on Behalf of Client for Claims Brought Related to Gender Discrimination

SMS attorney Lou Ann S. Cyrus obtained summary judgment on behalf of the West Virginia Division of Corrections and Rehabilitation, Commissioner Betsy Jividen, Superintendent JD Sallaz of Lakin Correctional Complex, and various correctional officers for claims brought related to gender discrimination by an inmate.

The plaintiff, an inmate serving a life sentence in West Virginia's only all-female maximum security prison, alleged her constitutional rights were violated based on gender discrimination while incarcerated, including wages and opportunities, were not equal for men and women.

The United States District Court for the Southern District of West Virginia ruled summary judgment on the defense's behalf. It issued a 100-page Memorandum Opinion and Order dismissing the Plaintiffs claims of retaliation and constitutional torts and gender discrimination.
